These Terms and Conditions (the “Terms”) govern your access to and use of the PlantSheets website, applications and related services (together, the “Service”). The Service is operated from Sweden by the individual behind PlantSheets (“PlantSheets”, “we”, “us” or “our”). PlantSheets is currently operated independently and is not yet established as a registered company. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
PlantSheets is a software-as-a-service (SaaS) application that lets plant collectors and home growers record and manage plant inventory, schedules, reminders and harvest data in a spreadsheet-style interface. We may add, change or remove features from time to time to improve the Service.
You must be at least 18 years old, or the age of legal majority in your country of residence, and able to enter into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide to us is accurate and complete.
To use most features you must create an account with a valid email address and a password. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at terms@plantsheets.com if you suspect any unauthorised use of your account.
New accounts may include a free trial period. After the trial ends, continued use of paid features requires an active paid subscription. We will make the current price, billing period and trial length available before you subscribe. Unless stated otherwise, subscriptions are billed in advance for the applicable period.
You agree to pay all fees for the plan you select. Prices are made available before you subscribe and may be exclusive of applicable taxes (such as VAT), which will be added where required by law. Subscriptions renew automatically at the end of each billing period so your access continues uninterrupted, and each renewal is charged at the same price you originally subscribed at unless we notify you of a change in advance. We will send you a reminder by email before each renewal. You can cancel at any time from your account or by contacting us; if you cancel, your subscription stays active until the end of the current paid period and does not renew again. Except where required by mandatory law, fees already paid are non-refundable.
If you are a consumer resident in the EU/EEA, you normally have the right to withdraw from a distance contract within 14 days without giving any reason. However, by starting to use the digital Service during this period you may expressly request that we begin performance immediately and acknowledge that you lose your right of withdrawal once the Service has been fully performed. To exercise any right of withdrawal, contact us at terms@plantsheets.com.
You retain all rights to the data and content you enter into the Service (“Your Content”). You grant us a limited licence to host, store, process and display Your Content solely as needed to provide and maintain the Service. You are responsible for Your Content and for ensuring you have the right to store it. We recommend you keep your own backups of important data.
You agree not to:
The Service, including its software, design, text and branding (but excluding Your Content), is owned by PlantSheets or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. No other rights are granted.
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Swedish data protection law. Our Privacy Policy explains what data we collect, how we use it, and your rights as a data subject. By using the Service you acknowledge our processing of personal data as described there. For privacy questions or to exercise your rights, contact us at terms@plantsheets.com.
The Service may rely on third-party providers (for example, email delivery and payment processing). Your use of such third-party services may be subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
We aim to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free or secure. To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Nothing in these Terms limits any warranty or right that cannot be excluded under mandatory law.
To the maximum extent permitted by law, PlantSheets shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or goodwill. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer rights.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we are required to do so by law. On termination, your right to use the Service ends; we may delete Your Content after a reasonable period in accordance with our data retention practices.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by email or a notice within the Service. The version and effective date at the top of this page indicate when the Terms were last updated. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules. Disputes shall be subject to the jurisdiction of the Swedish courts. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may also be entitled to bring proceedings in your local courts. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
